Foreign insurers approved to sell health insurance in U.S. territories (American Samoa, Puerto Rico, Guam, Northern Mariana Islands, U.S. Virgin Islands) may issue individual or group health insurance policies in Kentucky without obtaining Kentucky licensure

Qualifying foreign insurers must submit documentation to the Kentucky Department of Insurance including financial statements, policy forms, rates with actuarial certifications, and provider network information required by their territorial regulator

Policies issued under this exemption must incorporate all consumer protections required by the insurer's territorial regulatory authority, and Kentucky courts may enforce those protections

Foreign insurers operating under this exemption are exempt from all Kentucky insurance taxes, assessments, surcharges, fees, rate filing requirements, and policy form approval requirements under KRS Chapters 304 and 136

All marketing materials, applications, and contracts must prominently disclose that the laws of the relevant U.S. territory, not Kentucky law, govern the policy
