Nonprofit organizations that gratuitously donate medical equipment or supplies receive immunity from civil liability for injury, death, loss, civil penalties, or damages resulting from subsequent use of donated items

Donated equipment must be in proper working condition at the time of donation and cannot be subject to any product recall prior to or at the time of donation for immunity to apply

Liability protection does not apply if damage or injury was caused by gross negligence or willful or wanton misconduct by the nonprofit organization, its employees, or authorized agents

Creates new statute R.S. 9:2793.13 in Louisiana law
