Healthcare providers must refund patient overpayments within 90 days after the overpayment is identified and verified, with refunds issued in the same form as the original payment unless the patient requests otherwise

Providers must notify patients in writing or electronically when issuing a refund and maintain records of all overpayments and refunds for a minimum of three years

Louisiana Department of Health will assess a fine of $500 or the overpayment amount (whichever is greater) per violation for providers who fail to issue timely refunds

Patients may file complaints with the Louisiana Department of Health for violations of the refund requirements

Overpayments may be applied as credit toward a patient's outstanding balance with patient consent, or processed under state unclaimed property laws if the patient cannot be located
