Caregiver registries are explicitly excluded from the definition of "home- and community-based service provider" and are distinct from home health agencies, community-based service providers, and nurse staffing agencies

Caregiver registries are prohibited from employing, directing, or supervising caregivers; providing clinical oversight; or dictating terms of the care relationship between caregivers and clients

Registries must conduct background checks on all healthcare providers listed and must provide information about licensed healthcare providers and facilities through which caregivers may need to operate

Caregiver registries are prohibited from referring, matching, or placing caregivers to licensed healthcare facilities

"Caregiver" is defined to include registered nurses, licensed practical nurses, certified nursing assistants, personal care attendants, direct service workers, home health aides, companions, and homemakers whose services are not reimbursed by federal or state government programs
