Prohibits any corporation, person, or entity from using eminent domain to acquire surface rights or property interests for constructing or operating pipelines primarily intended to transport carbon dioxide

Bars the Commissioner of Conservation from issuing unitization orders for CO2 pipeline construction on private property without the property owner's consent

Removes existing authority allowing legal entities to expropriate property for transporting carbon dioxide for underground injection or storage

Eliminates storage operators' power to use eminent domain for laying, maintaining, and operating CO2 pipelines to storage facilities

Preserves eminent domain authority for CO2 pipelines used in enhanced oil/gas recovery projects (secondary or tertiary recovery of hydrocarbons)
