Agricultural producers, landowners, and gypsum suppliers receive civil liability protection when using byproduct gypsum from manufacturing facilities, provided they meet specific statutory requirements

Gypsum must be obtained at no cost from sources where it is stored as a manufacturing byproduct

Gypsum must pass analytical tolerances established by the Louisiana Department of Agriculture in consultation with the LSU Agricultural Center, with testing conducted by an accredited laboratory

Tolerances must follow the USDA Natural Resources Conservation Service's Conservation Practice Standard Code 333 and EPA soil amendment requirements

The commissioner may promulgate rules to implement the law, including establishing analytical tolerances for gypsum
