Creates new crime of second degree cruelty to elderly and persons with infirmities, defined as intentional or criminally negligent mistreatment or neglect causing serious bodily injury to persons age 60+, adults with disabilities, or persons with infirmities

Applies to any person or caregiver, including family members, neighbors, nursing homes, daycare facilities, adult congregate living facilities, hospitals, and mental health facilities

Designates the offense as a "crime of violence" under R.S. 14:2(B)

Penalties include imprisonment at hard labor up to 40 years; if the victim dies, mandatory 5-40 years with first 5 years served without parole, probation, or suspension of sentence

Provides affirmative defense for caregivers who provided treatment using a well-recognized spiritual healing method in lieu of medical treatment
