LA HB1025

Creates an affirmative defense for defendants charged with violating a protective order when the protected person knowingly and voluntarily initiated contact for the purpose of reconciliation of a marriage or restoration of the relationship

Requires the defendant to prove they did not initiate the contact that violated the protective order

Mandates that the contact must have occurred with the express request, invitation, or consent of the protected person

Excludes the affirmative defense if the defendant used force, threats, coercion, or intimidation to obtain the protected person's consent or participation

Applies to protective orders issued under domestic abuse statutes, divorce proceedings, and other civil proceedings in family court
