Public entities and the Department of Transportation and Development are prohibited from requiring contractors or subcontractors to demonstrate experience with specific proprietary materials, products, or systems as a condition for bidding or contract award

Experience or qualification requirements must be reasonably related to project scope and complexity, cannot unduly limit the bidder pool, and must be documented in writing with justification for public safety or project performance necessity

Public entities must offer alternate methods for contractors to demonstrate competency, including manufacturer certification, completion of training programs, comparable project experience, or submission of project-specific installation plans

Bidders cannot be disqualified solely for lacking prior experience with a specific proprietary product if they satisfy an alternate qualification method

Applies to both general public works contracts (R.S. 38:2212.11) and Department of Transportation and Development projects (R.S. 48:251)
