Political subdivisions (parishes, municipalities, school boards, sheriffs, special districts, etc.) must defend, indemnify, and hold harmless their officials, officers, and employees for claims arising from official duties, provided they acted in good faith and in the best interests of the subdivision

Protection does not apply if the individual is found liable for malfeasance in office or an intentional tort

Officials, officers, or employees who successfully defend against any action on the merits are entitled to reimbursement of expenses and attorney fees actually and reasonably incurred

Political subdivisions may advance legal defense expenses before final disposition, but the individual must agree to repay the amount if ultimately found not entitled to indemnification

Political subdivisions may purchase liability insurance for current or former officials, officers, and employees, regardless of whether indemnification would otherwise be permitted under the statute
