State fire marshal, first assistant fire marshal, and deputy fire marshals gain authority to investigate and arrest individuals, enforce state laws, and carry weapons (concealed or exposed) while performing duties, with the same powers as regular law enforcement officers

State arson investigators who obtain P.O.S.T. (Peace Officer Standards and Training) certification for firearms receive a commission authorizing them to carry and use firearms and make arrests

Local governing authorities may authorize fire protection district and fire department chiefs to commission local arson investigators with arrest and firearm authority, contingent on obtaining P.O.S.T. firearm credentials at the department's expense

Fire marshal officials receive immunity and legal defenses for acts performed within the course and scope of their employment

Initial provisions become effective upon governor's signature and expire June 30, 2028, when a replacement statute (R.S. 40:1563.1.1) takes effect with more limited arrest authority restricted to specific enumerated offenses including arson, bomb-related crimes, insurance fraud, and fire marshal order violations
