Tacitly dedicated roads (private roads maintained by a parish or municipality for 4+ years) remain public and subject to public use until the local governing authority formally revokes the dedication

Public works and improvements constructed within tacitly dedicated road rights-of-way also remain public unless disposed of in accordance with applicable law by the parish or municipality

Adjoining landowners or those who own property beneath a public right-of-way cannot sell tacitly dedicated roads through private sale

When a local authority disposes of a tacitly dedicated road, the property reverts to the original donor or heirs, who have 90 days to respond to certified mail notice before alternative disposal

Provisions apply both prospectively and retroactively
