LA HB82

Increases minimum imprisonment for second offense DWI from 1 year to 2 years, and minimum time without parole from 6 months to 1 year, when the offender has a prior conviction for vehicular homicide, third degree feticide, or first degree vehicular negligent injuring

Creates new enhanced penalties for third offense DWI when offender has prior conviction for vehicular homicide, feticide, or vehicular negligent injuring: $2,000 fine and 5-15 years imprisonment, with at least 5 years without parole

Creates new enhanced penalties for fourth offense DWI with same prior serious convictions: $5,000 fine and 12 months to 30 years imprisonment, with no parole eligibility and no concurrent sentencing

Expands recognition of equivalent convictions from other states for purposes of triggering enhanced penalties

Prohibits mandatory minimum sentences from being served on home incarceration, except as provided under R.S. 14:98.5(B)(1)
