Political subdivisions authorized to operate freshwater systems receive liability protection for damages caused by reducing or ceasing pumping operations or operating water control structures to lower water levels before forecasted weather events

Liability protection applies when actions are taken pursuant to an operational plan implemented in preparation for weather events forecasted by the National Weather Service or GOHSEP

Protection does not extend to acts or omissions constituting gross negligence or willful or wanton misconduct

Applies only to political subdivisions covering four parishes where at least one parish has a population between 145,000 and 350,000 according to the most recent federal census

Effective August 1, 2026
