General damages in delictual (tort) actions are capped at $500,000, regardless of the number of defendants or lawsuits filed

Cap increases to $1 million if the trier of fact finds the claimant suffered a permanent mental injury that severely impairs their ability to work or maintain a reasonable standard of living

Caps do not apply to permanent and severe physical injuries, including substantial disfigurement, loss of limb, loss or substantial impairment of a major organ or body system, or injuries rendering the claimant incapable of independent self-care

Caps do not apply when clear and convincing evidence shows the tortfeasor's actions were intentional or malicious

Effective August 1, 2026; creates new Civil Code Article 2315.14
