LA SB38

Adds a statutory definition of "license" as permission granted by the Louisiana Department of Health to operate a nursing facility

Requires the department to hold a revoked nursing facility license in abeyance and reissue it to a qualified applicant when revocation resulted from failures during an emergency evacuation

Exempts reissued licenses from facility need review and moratorium requirements under R.S. 40:2116.1, allowing faster reopening of patient services at the same or replacement facility in the same geographic area

Applies only to nursing facilities with no alternative facility within 10 miles and to emergencies declared during or after 2021

Takes effect upon the governor's signature or lapse of time for gubernatorial action
