LA SB399

Creates the Louisiana Higher Education Research Security Council composed of representatives from the lieutenant governor's office, attorney general's office, Board of Regents, and research security officers from each public university system and independent colleges

Requires institutions of higher education to obtain assessments from federal law enforcement and the new council before accepting any gift, contract, or research partnership from foreign adversary sources; the council has veto authority over such partnerships by majority vote

Prohibits university employees from accepting travel, lodging, or gifts from foreign adversaries, and requires reporting of any interactions with foreign adversary representatives to the Louisiana Board of Ethics within 30 days

Bans Chinese Communist Party organizations from operating on university property and prohibits party members, People's Liberation Army members, or Chinese intelligence affiliates from enrolling or receiving employment at Louisiana institutions

Establishes penalties including $10,000-$20,000 fines for disclosure failures, civil penalties of 105% of undisclosed gifts, and enhanced criminal penalties of 5-25 years imprisonment for theft of trade secrets valued at $25,000 or more on behalf of foreign adversaries
