LA SB46

Creates new crime of unlawful operation of a group home, defined as operating an unlicensed residence housing two or more non-related individuals who receive daily living assistance and over whom the operator exercises control

Establishes operator control through evidence such as holding power of attorney over residents' assets, receiving government benefits on residents' behalf, or serving as representative payee

Penalties for basic violations (no unjustifiable pain or suffering): fine up to $1,000 and/or up to 6 months imprisonment

Penalties when conditions cause or likely cause pain, malnourishment, or suffering: fine up to $10,000 and/or up to 10 years imprisonment, with at least 1 year served without parole, probation, or suspension

Penalties when conditions contribute to resident death: 5-40 years hard labor, with at least 3 years served without probation or suspension
