Retailers prohibited from selling single-use beverage containers unless caps are tethered to prevent separation or include a drinking opening while attached, effective January 1, 2024

Plastic beverage containers (1 liter or less) must contain minimum 15% postconsumer recycled plastic starting January 1, 2024, increasing to 20% in 2026 and 25% in 2027

Department of Environmental Protection may adjust recycled content standards based on market conditions, supply, technology, and environmental factors, but cannot set below the established minimums

Non-compliance carries fines up to $100,000 per manufacturer; false certification submissions may result in fraud prosecution by the state attorney general

Containers reused and refilled at least five times are exempt; glass and metal containers with plastic caps are excluded from the requirements
