Commissioner of Insurance would set minimum hourly labor rates that insurers must pay to registered motor vehicle repair shops for insured collision claims

Minimum rate calculated by repair shops submitting either 100 sequential customer-paid repair orders or 60 consecutive days of orders (whichever is less) to establish their average customer-paid hourly rate

New rates take effect 30 days after declaration, with insurers having the right to audit submitted orders and rebut the declared rate within 30 days

Repairers who disagree with insurer-proposed rates may file an action with the Commissioner of Insurance, with the burden of proof on insurers to show the declared rate was inaccurate or unreasonable

Collision repair labor rates set under this section would be excluded from insurance cost control programs, with implementing regulations required within 90 days of enactment
