Secretary of Health and Human Services must direct monthly enhanced Medicaid payments to eligible hospitals equal to 5% of each hospital's average monthly Medicaid payments for inpatient and outpatient acute services from the preceding year

Total payments to all eligible hospitals capped at $35,000,000 per fiscal year

Enhanced payments cannot be used to calculate future average monthly payments and cannot offset other existing Medicaid payments hospitals qualify to receive

Eligible hospitals defined as non-profit or municipal acute care hospitals licensed under Chapter 111, Section 51 that received enhanced Medicaid payments under the 2020 acts (Chapter 260, Section 63) during calendar years 2021 and 2022

Secretary may impose conditions to maximize federal financial participation and may promulgate regulations to implement the program
