Creates a 16-member Technical Advisory Committee to recommend an adjustment factor (ranging from -1% to +1%) to the benchmark, based on medical inflation, labor costs, pharmaceutical/device costs, and other health care industry factors

Requires health care entities exceeding cost growth benchmarks to file performance improvement plans within 45 days, with implementation timelines capped at 3 years

Authorizes civil penalties of up to $500,000 for first violations, $750,000 for second violations, and $1,000,000 for third or subsequent violations for entities failing to comply with performance improvement plan requirements

Requires the Secretary of Administration and Finance to meet with legislative Ways and Means committees by January 15 before each benchmark cycle to jointly develop the potential gross state product growth rate
