Courts must order defendants convicted of vehicular homicide while intoxicated to pay monthly restitution to the victim's surviving children when the victim was a parent or guardian

Restitution payments continue until the child reaches age 18 or graduates high school, whichever is later

Children pursuing higher education may receive restitution until age 22 or graduation from a higher education program, whichever comes first

Courts determine payment amounts based on factors including the child's financial needs, standard of living, educational needs, custody arrangements, and the surviving parent's resources and childcare expenses

Incarcerated defendants must begin payments no later than 1 year after release and may enter into a payment plan to address any arrearage
