Amends Section 148B of Chapter 149 of the Massachusetts General Laws to modify the test for determining whether a worker is an independent contractor or employee

Retains two existing criteria: the worker must be free from control and direction in performing the service, and the service must be performed outside the employer's usual course of business

Changes the third criterion from a requirement that must be met alongside the other two to an alternative "or" condition, allowing workers to qualify as independent contractors if they are customarily engaged in an independently established trade, occupation, profession, or business
