Division of Capital Asset Management and Maintenance may grant permanent easements to the City of Lowell over approximately 6,750 square feet of state land along the Merrimack River currently managed by the Department of Conservation and Recreation

Easements are restricted to construction, maintenance, operation, and removal of outfall structures and mainline drains for the Bunker Hill Outfall project

City of Lowell must compensate the Commonwealth at full fair market value or value in use (whichever is greater), either through cash payment or improvements to nearby DCR property, with funds deposited into the Conservation Trust

City must pay all appraisal, survey, and transaction costs; the Inspector General must review and approve the property appraisal before conveyance

Easements automatically revert to the Commonwealth if the city stops using them for the authorized drainage purposes, and any work performed must restore surface conditions to equivalent or better condition
