Home care agencies contracting with the state to provide services under the Department of Elder Affairs home care program must enter into labor peace agreements with labor organizations seeking to represent their workers

Labor peace agreements require both employers and unions to commit to uninterrupted delivery of home care services and refrain from actions that would disrupt services

Covered employers must submit attestations identifying which employee classes are covered by labor peace agreements, and have 90 days to reach an agreement when a union seeks to represent workers after contract award

Employers must certify CEO contact information, compliance commitment, and disclose any labor law violations from the preceding 5 years before receiving contracts

Failure to comply may constitute material breach of contract with 60 days to cure; two violations within 4 years results in a 4-year ban from bidding on department contracts
