Prohibits food establishments from using, selling, or distributing disposable food service ware made from black plastic (resin codes #1-#7) one year after passage

Bans retail establishments from selling black plastic food serviceware, meat trays, fish trays, seafood trays, vegetable trays, and egg cartons made with black plastic

Exempts individuals using black plastic items purchased out-of-state and prepared foods packaged outside Massachusetts that remain in original packaging

Allows Department of Environmental Protection or local Boards of Health to grant up to 6-month exemptions for undue hardship or inventory drawdown

Establishes penalties of written warning for first offense, $50 for second offense, and $300 for third and subsequent offenses, with each day of noncompliance counting as a separate violation
