Youthful offenders must receive credit toward their sentence for time spent in secure detention facilities or on electronic monitoring bracelets while awaiting trial, pursuant to Chapter 279 Section 33A

Department of Youth Services (DYS) must submit a pre-adjudication report to the court for detained youth that includes length of detention, time on electronic monitoring, participation in educational/vocational programming, and behavior during pre-trial period

Reports to the court shall include only positive details that could favorably impact sentencing

DYS must incorporate pre-trial detention time, program participation, and behavior into internal evaluations once a youthful offender is committed to their custody

DYS must inform detained youth before adjudication that their behavior, compliance, and program participation will be considered in both sentencing and post-commitment evaluations
