Creates new Section 32O in Chapter 94C of Massachusetts General Laws establishing second-degree murder charges for drug traffickers or distributors whose controlled substances cause a death

Applies to anyone who knowingly or intentionally manufactures, distributes, dispenses, delivers, gives away, barters, administers, or provides any amount of a controlled or counterfeit substance resulting in death

Requires the defendant to be engaged in trafficking or unlawful distribution as defined in existing section 32E at the time of the offense

Eliminates lack of knowledge about a victim's pre-existing health condition as a valid legal defense
