Health care entities identified as contributing to excessive health care spending growth must be notified by the Health Policy Commission and may be required to file a performance improvement plan within 45 days

Entities may apply for a waiver or extension based on factors including spending trends over time, ongoing efficiency strategies, unanticipated cost factors, and overall financial condition

Performance improvement plans must include specific strategies, measurable outcomes, and a timetable not exceeding 18 months; the Commission must publicly post which entities are implementing plans

Civil penalties up to the amount of spending exceeding the health care cost growth benchmark may be assessed for failed plans, willful noncompliance, or falsifying information, with funds deposited into the Payment Reform Fund

The Center for Health Information and Analysis must identify and publicly list entities whose spending growth threatens state cost benchmarks or who fail to submit required data properly
