Secretary of the Executive Office of Health and Human Services would establish payment rates for Adult Day Health Service providers, with authority to delegate ratemaking to another governmental unit

Rate adjustments must account for costs of government mandates, changes in goods/services/transportation costs (at minimum the Health Care Provider CPI), wages and benefits comparable to direct care staff in other health settings, and individual provider real estate and capital costs

Adult Day Services rates would be established biennially as of July 1

MassHealth would reimburse Adult Day Health Programs to reserve program slots for members during up to 20 medical leave-of-absence days and up to 10 non-medical leave-of-absence days annually

Programs cannot reassign a participant's slot during a reimbursable leave of absence
