Hotels, motels, and lodging facilities contracted by Massachusetts for emergency housing must maintain general liability and property damage insurance covering damages caused by program occupants.

Facilities must provide annual proof of insurance to the executive office before signing or renewing any contract.

The Commonwealth is explicitly shielded from financial responsibility for property damage, repair costs, replacement costs, insurance deductibles, or lost revenue from unusable rooms caused by emergency housing occupants.

Non-compliant facilities face contract termination, financial penalties, and disqualification from future state housing contracts.

The Executive Office of Housing and Livable Communities is directed to promulgate rules and regulations for implementation.
