Creates new criminal offenses for gift card theft, including taking a gift card without consent or receiving a stolen gift card with intent to use, sell, or transfer it

Prohibits selling gift cards unless the seller is the issuer or authorized by the issuer, and prohibits buying gift cards from unauthorized sellers

Criminalizes falsely making or embossing gift cards, possessing counterfeit gift cards, and signing a gift card with intent to defraud when not the intended recipient

Establishes tiered penalties: for cards under $100, up to 90 days imprisonment and/or $500 fine; for cards $100 or more, up to 6 months (first offense) or 1 year (subsequent offenses) and/or $500 fine

Takes effect October 1, 2025
