Prohibits intentionally harassing, intimidating, or threatening another person while wearing a mask or face covering to conceal identity, when done with intent to cause reasonable fear of physical harm

First offense is a misdemeanor punishable by up to 90 days imprisonment and/or a fine up to $500; second or subsequent offenses carry up to 180 days imprisonment and/or a fine up to $1,000

Convictions under this section may not merge with convictions for other crimes arising from the same conduct, and sentences may run consecutively

Provides affirmative defenses for masks worn during holidays/celebrations, for occupational protective equipment, weather protection, theatrical productions, emergency situations, preventing airborne illness, or religious purposes

Effective October 1, 2025
