Secretary of Higher Education may approve requests from private career school applicants to advertise and collect contact information from potential students before receiving a certificate of approval to operate

Approved schools may only advertise information about the school opening, including anticipated opening date, programs of instruction, and application process

All advertisements must include a disclosure that the certificate of approval to operate is pending

Schools advertising under this provision are prohibited from collecting any fees or entering into enrollment agreements with potential students

Secretary of Higher Education is required to adopt regulations establishing the approval process for pre-certification advertising; effective date is July 1, 2025
