Law enforcement agencies, agents, and local detention facilities must run a National Crime Information Center (NCIC) search on every individual taken into custody

If the search reveals an individual is unlawfully present in the U.S. and has an outstanding criminal warrant, authorities must notify federal immigration authorities of the custody and planned release information

Upon federal request, local authorities must hold the individual for up to 48 additional hours and cooperate with transferring custody to federal immigration authorities

State and local governments, county sheriffs, and government agencies are prohibited from adopting policies that limit cooperation with federal immigration authorities regarding individuals with outstanding criminal warrants who are unlawfully present

Law enforcement must provide an interpreter for individuals who need one during investigations under this section; effective date is October 1, 2025
