Appointed members of county boards of education are prohibited from serving as president, vice president, chair, or vice chair of the board, though members appointed to fill vacancies in elected positions are exempt from this restriction

Appointed members currently serving in leadership positions on July 1, 2025 must vacate those positions by August 1, 2025

County boards that violate the prohibition must remove the appointed member from leadership within 30 days of receiving written notice from the State Department of Education, or face suspension of administrative funding and required public posting of the violation

After 60 days of non-compliance, the Department may withhold additional administrative funding and refer the matter to the Attorney General for enforcement

Appointed members who knowingly and willfully continue serving in leadership positions in violation may face civil penalties up to $2,500
