In-network health care providers are prohibited from charging patients fees to obtain prior authorizations from carriers or managed care organizations

"Carrier" is defined to include health insurers, nonprofit health service plans, health maintenance organizations, and other state-regulated entities providing health benefit plans

"Prior authorization" refers to the utilization management process requiring advance approval for procedures, treatments, medications, or services to determine medical necessity and benefit eligibility

The law applies to all health insurance policies, contracts, and health benefit plans issued, delivered, or renewed in Maryland

Effective date: January 1, 2026
