Covered buildings that received a use and occupancy permit before June 1, 2022 would be exempt from Maryland's building energy performance standards and energy use intensity targets

The exemption continues until the building requires replacement of lighting systems, HVAC systems, or other major components due to failure or end of life

Current law requires covered buildings (commercial or multifamily buildings 35,000+ square feet) to achieve 20% greenhouse gas emissions reduction by January 1, 2030 and net-zero emissions by January 1, 2040

The bill would take effect October 1, 2025
