Counties and municipalities would be prohibited from allowing developers to pay a fee instead of actually building required moderate income housing units in new residential developments

Local governments retain authority to support affordable housing through trust funds, fee waivers, density bonuses, providing land, and PILOT (payment in lieu of taxes) programs

The prohibition applies only prospectively and does not affect fee-in-lieu payments authorized before the effective date
