Repeals the existing certificate of need (CON) exemption for bed capacity changes at intermediate care facilities offering residential or intensive substance use disorder treatment services

Creates a new CON exemption for bed capacity changes at intermediate care facilities offering medically managed residential substance use disorder treatment services, subject to Commission approval

Establishes a new CON exemption for establishing or operating intermediate care facilities that offer medically managed residential substance use disorder treatment services

Requires facilities seeking the exemption to file written notice with the Commission at least 45 days before establishment or bed capacity change

Commission must find the proposed facility or change is consistent with the State health plan, will result in more efficient and effective health care services, and is in the public interest

Effective date: October 1, 2025
