Clarifies that expungement laws do not prohibit disclosure of records that contain information also found in expunged records, are formatted for research purposes, and contain de-identified case data

Maintains existing protections requiring a court order to open, review, or disclose information from expunged records

Preserves the ex parte order process allowing State's Attorneys to access expunged records for pending criminal investigations when immediate access is needed to protect life or property

Retains penalties for unauthorized disclosure: misdemeanor conviction with fines up to $1,000, imprisonment up to 1 year, or both; public employees may also face removal from service

Effective date: October 1, 2025
