Changes the baseline date for calculating reimbursement rates to nonparticipating (out-of-network) health care providers from "January 1 of the previous calendar year" to a fixed date of January 31, 2019

Requires HMOs to inflate the January 31, 2019 baseline rates by the change in the Medicare Economic Index from 2019 to the current year when paying nonparticipating providers

Applies to both evaluation and management services (minimum 125% of average contracted rate or 140% of Medicare) and non-evaluation/management services (minimum 125% of average contracted rate)

Effective date: October 1, 2025
