Licensed auctioneers acting on behalf of a seller, secured party, or owner are exempted from the definition of "dealer" under the State Boat Act, meaning they do not need to comply with dealer licensing and regulatory requirements

The exemption applies only when title to the vessel does not pass to the auctioneer and the auction is not conducted to avoid provisions of the State Boat Act

Auctioneers were previously included in the definition of "dealer" when selling vessels pursuant to liens under Title 16, Subtitle 2 of the Commercial Law Article; this language has been removed
