Former members of the State Police Retirement System, Correctional Officers' Retirement System, or Law Enforcement Officers' Pension System who were members on or before June 30, 2011, and return to service in the same system retain their pre-2011 benefit structure requirements

Returning members must meet one of three conditions: separated from employment for 4 years or less, separated for qualifying military service and returned within 1 year, or separated with minimum vesting eligibility

Returning members must not have withdrawn their accumulated contributions and must not have become retirees during their separation

The law preserves grandfather protections for employees who earned vested benefits under the pension rules in effect before July 1, 2011 pension reforms

Effective date: July 1, 2025; approved by Governor Wes Moore on May 20, 2025
