Married testators or those in registered domestic partnerships may not sign their will in the physical or electronic presence of their spouse or domestic partner

Witnesses who sign one spouse's or domestic partner's will are prohibited from also witnessing and signing the will of the other spouse or domestic partner

Applies to both traditional in-person will signings and electronic/remotely witnessed wills

Takes effect October 1, 2025 and applies only prospectively to wills executed after that date
