Governing bodies of condominiums and cooperative housing corporations must develop smoking policies for multifamily dwellings with 4 or more units that have common entrances and shared areas like hallways, elevators, and stairs.

Smoking policies must be at least as stringent as applicable state and local laws and must specify where smoking is authorized, where it is prohibited, conditions on smoking in permitted areas, the complaint process, and penalties for violations.

"Smoking" includes traditional smoking of lighted substances as well as vaping devices that deliver aerosolized or vaporized vaping liquid.

Local governments retain authority to enact and enforce smoking policies more stringent than those required under this section.

Effective date: October 1, 2025.
