Restrictions on solar collector system installation are deemed unreasonable if they increase installation costs by at least 5% or reduce energy generation by at least 10% compared to the initially proposed installation

Property owners must provide documentation from a certified solar panel design specialist (NABCEP-certified or with 30+ systems designed in prior 3 years) to demonstrate a restriction is unreasonable

Community associations may prohibit or restrict solar collector systems in common areas and common elements, and may establish reasonable rules on number, size, place, or manner of installation

Community association boards have discretion to install solar systems in common areas unless otherwise prohibited by applicable law

Historic properties listed in or eligible for the Maryland Register of Historic Properties are exempt from these protections; effective October 1, 2025
