Establishes a minimum base fee of $2.30 per ton for coal combustion by-products generated annually, and adds the volume of disposed by-products remaining in state landfills and storage units as a factor in setting fees

Redirects excess fee revenue from reducing future fees to instead funding increased beneficial reuse of coal combustion by-products and mitigating health and environmental impacts at priority sites

Creates the Statewide Coal Combustion By-Products Coordinating Committee, comprising the Secretary of Environment, representatives from environmental justice and power plant research programs, and three technical experts in coal by-products, public health, and water quality

Requires the Coordinating Committee to meet at least twice yearly beginning in 2026 to share monitoring results and discuss remedial actions at coal combustion by-product sites, with annual reports to the General Assembly

Mandates the Department of the Environment adopt regulations by October 1, 2026 implementing federal legacy coal combustion residuals rules, with authority to expand required chemical testing to include arsenic, boron, cadmium, hexavalent chromium, radium 226, selenium, and vanadium
