Clarifies that State contracts cannot include provisions limiting liability for damage to real property or tangible personal property of the State caused by negligence, intentional misconduct, fraud, recklessness, or other tortious conduct

Expands the State's ability to recover replacement contractor costs when the combined payments to the replacement and original contractor exceed the original contract amount for services not performed

Prohibited contract provisions are void ab initio (from the beginning), and contracts remain enforceable as if those provisions were never included

Does not apply to State contracts related to racing facility or training facility purchases, redevelopment, or operations

Takes effect October 1, 2025
